May is National Foster Care Month: New Steps to Stop State Agencies from Taking Social Security Benefits from Foster Youth
|
For the past several years, the Children's Advocacy Institute (CAI) at USD's School of Law has been at the forefront of efforts nationwide to stop state and county foster care agencies across the country from using social security benefits of eligible foster youth to reimburse the agencies for the cost of their foster care services -- often without notice. This is a trending issue, with the Marshall Project and NPR recently echoing CAI's concerns and several jurisdictions passing new laws to curb or prohibit such practices. For example, New York City says they will stop collecting social security funds from foster care children and Philadelphia has a pending bill to end the practice altogether, according to The Imprint. A representative from the Children's Advocacy Institute can talk about how CAI has been at the forefront of efforts around the country to put an end to this practice, including its recent filing of an amicus brief in the Alaska Supreme Court seeking to prohibit the state of Alaska from seizing the federal Social Security and disability benefits of Alaska foster children to reimburse the state for their foster care costs.
